Privacy Policy

KLASS respects the privacy of our community, clients, event attendees, partners, and website visitors. In connection with our website, events, bookings, inquiries, registrations, email list, and other services, KLASS may collect information including your name, email address, telephone number, event registration information, transaction information, event preferences, communications with KLASS, business or brand information, uploaded materials, marketing preferences, and other information that you voluntarily provide. We may also receive certain technical or transactional information through the platforms and service providers we use to operate our website and events. KLASS uses this information to process event registrations and purchases, communicate event information, respond to inquiries, provide event-planning and production services, manage customer relationships, operate and improve our business, send marketing communications when permitted, maintain business records, prevent fraud or misuse, and comply with applicable legal obligations. KLASS may use third-party providers for services such as payment processing, ticketing, website hosting, email communications, event management, and other operational functions, and information may be shared with such providers when reasonably necessary to provide those services. Payment-card information should be processed and maintained through authorized payment processors rather than directly stored by KLASS whenever reasonably practicable. KLASS does not sell personal information to advertisers. We use reasonable administrative, technical, and organizational measures appropriate to the information we maintain; however, no electronic storage or transmission method can be guaranteed to be completely secure. Information may be retained for as long as reasonably necessary for business operations, accounting, legal compliance, customer service, fraud prevention, dispute resolution, and other legitimate business purposes. Marketing recipients may unsubscribe from promotional emails using the unsubscribe mechanism provided in those communications, although KLASS may continue to send necessary transactional or event-related communications. Questions regarding privacy or personal information may be submitted using the contact information provided on the KLASS website.

Terms & Conditions

By accessing the KLASS website, purchasing or registering for an event, participating in a KLASS experience, submitting an event inquiry, purchasing event services, or otherwise using KLASS services, you agree to the applicable terms and policies presented by KLASS. Event registrations are subject to availability and applicable capacity restrictions, and KLASS reserves the right to establish reasonable event rules and safety requirements. KLASS may refuse admission or remove an individual when reasonably necessary because of unsafe, threatening, abusive, discriminatory, unlawful, disruptive, or otherwise inappropriate conduct. Event details may occasionally change because of weather, safety considerations, venue requirements, instructor or vendor availability, operational requirements, emergencies, or circumstances outside KLASS’s reasonable control. Accordingly, KLASS may make reasonable changes to instructors, vendors, sponsors, programming, layouts, schedules, products, refreshments, goodie-bag contents, activities, capacities, or other event elements when necessary. Unless expressly guaranteed in writing, the appearance or participation of a particular instructor, vendor, sponsor, influencer, product, activation, gift, or amenity should not be considered guaranteed. Attendees are responsible for their own personal belongings, timely arrival, compliance with event and venue rules, and bringing any equipment identified in the event description. To the fullest extent permitted by applicable law, KLASS is not responsible for lost, stolen, misplaced, or damaged personal property except where liability cannot lawfully be excluded.

Refund & Cancellation Policy

Unless otherwise expressly stated on an individual event listing or required by applicable law, KLASS event tickets are non-refundable. Failure to attend an event, late arrival, transportation difficulties, scheduling conflicts, personal emergencies, illness, or changes in personal circumstances do not automatically entitle a purchaser to a refund. Ticket transfers or event credits may be permitted at KLASS’s discretion and subject to any conditions communicated for the applicable event. Promotional codes, complimentary registrations, event credits, and special offers have no cash value unless otherwise expressly stated. If KLASS cancels an event entirely and does not provide a replacement date or comparable alternative, KLASS will communicate the refund, transfer, credit, or other remedy applicable to that event. If an event is rescheduled, registrations may automatically transfer to the new date unless otherwise communicated. Outdoor and special events may be affected by weather, venue closures, government orders, public emergencies, utility failures, transportation disruptions, instructor illness, vendor cancellation, safety concerns, acts of God, or other circumstances outside KLASS’s reasonable control. KLASS may reasonably postpone, relocate, modify, shorten, reschedule, or cancel programming when circumstances require, and any available refund or credit will be determined according to the circumstances, the applicable event terms, and applicable law.

Event Participation, Assumption of Risk & Release of Liability

Participation in KLASS events and activities is voluntary and may include Pilates, yoga, tennis, stretching, mobility work, strength or conditioning activities, outdoor fitness, group exercise, recreational activities, wellness experiences, and other forms of physical movement. Physical activity inherently involves risks, including but not limited to slips, trips, falls, muscle soreness, strains, sprains, bruising, collision with people or objects, equipment-related injuries, dehydration, heat-related illness, allergic reactions, aggravation of existing conditions, cardiovascular events, serious bodily injury, disability, and, in rare circumstances, death. By voluntarily participating, you acknowledge the nature of these risks and accept responsibility for determining whether participation is appropriate for you. Participants are responsible for understanding their own physical limitations, using equipment appropriately, following reasonable safety instructions, requesting modifications when necessary, stopping any activity that feels unsafe, and obtaining medical advice when appropriate. KLASS events and instructors do not provide individualized medical diagnosis or medical treatment merely by conducting an event.

To the fullest extent permitted by Indiana law, and in consideration for being permitted to participate in a KLASS activity, each participant voluntarily assumes the inherent risks associated with participation and agrees to release and hold harmless KLASS and its owners, officers, employees, agents, event staff, volunteers, and participating instructors from claims for personal injury or property damage arising from the ordinary negligence of the released parties in connection with the participant’s voluntary participation in KLASS activities, including use of event facilities and equipment, except to the extent such liability cannot lawfully be waived or released. Nothing in these terms is intended to waive or release liability that applicable law prohibits a party from waiving, including conduct that cannot legally be disclaimed. Participants understand that exercise instruction cannot eliminate every risk of injury and that instructions and demonstrations are general in nature and may not be appropriate for every individual. Participants remain responsible for listening to their bodies, deciding whether to perform or modify an exercise, and stopping when necessary. If a participant appears to require urgent medical assistance, KLASS personnel or others may contact emergency services, and participants remain responsible for their own medical expenses except where applicable law provides otherwise.

Photography & Media Policy

KLASS events may be photographed, filmed, recorded, livestreamed, or otherwise documented by KLASS, authorized photographers, videographers, content creators, sponsors, partners, vendors, or other authorized event personnel. Images, video, audio, likenesses, and other event content may be used for lawful KLASS business and promotional purposes, including social media, websites, event recaps, advertising, email marketing, printed materials, public relations, sponsor or partnership recaps, and future promotional materials. Where legally effective consent is required, KLASS may obtain media consent through registration, ticket checkout, a waiver, or another affirmative process. By providing such consent, the participant authorizes KLASS to photograph, film, record, reproduce, publish, display, distribute, and use the participant’s image, likeness, appearance, and voice for the stated purposes without additional compensation unless otherwise required by law. Attendees who have concerns regarding identifiable photography or recording should contact KLASS before the event so that reasonable accommodations can be considered. KLASS cannot guarantee that an individual will never appear incidentally in wide-angle crowd photographs, backgrounds, event footage, or content independently captured and published by other attendees or third parties. Professional content created by or for KLASS remains owned by KLASS or the applicable creator or licensor, subject to applicable agreements, and may not be commercially exploited by third parties without appropriate authorization.

Independent Vendors, Sponsors, Instructors & Third Parties

KLASS events may involve independent instructors, vendors, sponsors, venues, photographers, food and beverage providers, wellness professionals, beauty providers, retailers, contractors, creators, and other third-party businesses. Unless expressly stated otherwise in writing, these parties operate independently and are responsible for their own personnel, products, services, professional qualifications, representations, licenses, permits, certifications, insurance, taxes, safety practices, business operations, and compliance with applicable laws and regulations. The presence of a third party at a KLASS event does not by itself establish an employment relationship, partnership, agency relationship, joint venture, endorsement, warranty, or guarantee by KLASS. KLASS may request documentation, representations, certifications, licenses, or insurance from third parties when appropriate; however, KLASS does not guarantee the authenticity, completeness, accuracy, or continuing validity of information independently supplied by those parties. A vendor or professional who falsifies licensing, insurance, certification, qualifications, or other material information remains responsible for its own misrepresentation and conduct. If KLASS reasonably becomes aware that a third party lacks a required qualification or presents a material safety or compliance concern, KLASS may remove or replace that party where reasonably practicable. Nothing in this section is intended to exclude responsibility that applicable law does not permit KLASS to exclude.

Venue & Premises Policy

KLASS may host experiences at venues and properties owned, leased, operated, or controlled by independent third parties. Such venues remain responsible for matters within their control, including the condition of their premises, legally required disclosures, building requirements, occupancy limitations, venue-specific rules, and representations made to KLASS regarding the property. Attendees and clients are responsible for complying with applicable venue policies and reasonable safety instructions. To the fullest extent permitted by law, KLASS is not responsible for a dangerous condition, undisclosed restriction, defect, regulatory issue, or other material circumstance that an independent venue failed to disclose and that KLASS did not know or reasonably have reason to know about. Nothing in this provision limits responsibility that applicable law does not permit KLASS to disclaim.

Event Services Terms

KLASS may provide event planning, production, management, venue sourcing, instructor sourcing, vendor coordination, attendee management, registration, goodie-bag production, sponsor sourcing, branding, décor, photography coordination, staffing, refreshments, wellness activations, and other event-related services. A client’s purchased services are limited to those expressly identified in the client’s confirmed proposal, invoice, checkout, booking confirmation, or written agreement. Any product, service, customization, vendor, décor element, staffing requirement, or other request not included in the confirmed scope is considered an additional request and may be subject to additional fees, availability, production timelines, and written approval by KLASS. Clients are responsible for providing accurate and timely information, including logos, branding assets, guest counts, product quantities, sponsor details, vendor information, VIP requirements, event expectations, approvals, and client-supplied materials. KLASS is not responsible for delays, errors, additional costs, or inability to perform caused by materially inaccurate, incomplete, or late information supplied by a client or third party under the client’s control, except to the extent otherwise required by law.

Clients remain responsible for vendors, sponsors, products, content, and other third parties they independently select, hire, introduce, or provide. KLASS’s coordination with such parties does not transform them into KLASS employees or constitute a guarantee of their performance. Likewise, third parties identified or coordinated by KLASS generally remain responsible for their own services, qualifications, licenses, representations, conduct, products, personnel, and legal compliance unless KLASS expressly agrees otherwise in writing. Sponsor participation, donated products, influencer attendance, vendor attendance, ticket sales, event attendance, social-media reach, profitability, and event sellout are not guaranteed unless expressly guaranteed in a written agreement.

Public and private events may use different financial structures. Public-event pricing may account for public registration and ticket revenue as part of the overall event-production model, while private-event pricing is based on the client funding the agreed private experience without reliance on public ticket sales. Ticket revenue, VIP revenue, sponsorship proceeds, commissions, and revenue-sharing arrangements are governed exclusively by the applicable written agreement with KLASS. The use of terms such as “collaboration,” “partnership,” “co-host,” or similar marketing language does not, by itself, establish a legal partnership, joint venture, or entitlement to ticket revenue or event profits.

Payment amounts, deposits, installment schedules, cancellation provisions, and final payment deadlines are governed by the applicable booking confirmation, proposal, invoice, checkout terms, or event agreement. Unless expressly stated otherwise, an event is not considered confirmed until the required initial payment has been received. Approved additional services and third-party expenses may require additional payment. Clients are responsible for reviewing and approving event names, logos, designs, quantities, branding, ticket structures, VIP offerings, and other materials when approval is requested, and KLASS may reasonably rely on approvals once provided.

Event Services Cancellation & Client Changes

Event-service cancellations, postponements, and rescheduling requests are governed by the client’s applicable booking agreement. Deposits, committed venue costs, custom products, printing, branding materials, vendor retainers, personalized goods, and other costs already incurred or irrevocably committed may be non-refundable to the extent permitted by law and the applicable agreement. Requests to materially change the event after planning or production has begun may result in additional charges and are subject to KLASS’s ability to accommodate the requested change. KLASS is not required to provide products, services, staffing, vendors, décor, customization, or other deliverables that were not included in the confirmed event scope without a separate agreement or additional payment.

Client Responsibility & Indemnification

To the fullest extent permitted by applicable law, event-service clients are responsible for materials, products, content, vendors, sponsors, personnel, intellectual property, and other elements they supply or independently arrange. A client agrees to defend, indemnify, and hold harmless KLASS from third-party claims, losses, liabilities, damages, or reasonable costs arising from client-supplied materials or products, client-selected vendors or sponsors, infringement caused by content supplied by the client, unlawful acts of the client or persons acting under the client’s direction, or the client’s material breach of its event agreement, except to the extent the applicable claim results from conduct for which Indiana law does not permit KLASS to obtain indemnification. This provision should be read together with, and remains subject to, any more specific indemnification terms contained in the client’s written event agreement.

Limitation of Liability

To the fullest extent permitted by applicable law, KLASS will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of KLASS services or event-production services, including lost profits, lost business opportunities, reputational harm, or similar economic losses, except where such limitation is prohibited by applicable law. Nothing in these policies is intended to eliminate or limit a right or remedy that cannot lawfully be waived. Any contractual cap on direct damages applicable to event-service clients should be stated in the client’s specific event agreement and reviewed by qualified legal counsel.

Governing Law & Sever ability

These policies and terms are governed by applicable federal law and the laws of the State of Indiana, without regard to conflict-of-law principles, except where another governing law is legally required. If any provision is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted, modified, or limited to the extent reasonably necessary to make it enforceable where permitted, and the remaining provisions will continue in effect. KLASS may update these policies periodically to reflect changes in its services, business practices, or legal obligations. The current version and effective date will be posted on the KLASS website.\
